Women Launch Class Action Over Botched Operations

14-May-2010

More than 200 women are suing an NHS hospital over botched bladder operations in what could turn out to be one of the biggest class action lawsuits in British medical history.

The women all underwent operations carried out by consult surgeon George Rowland for Liverpool Women's NHS Foundation Trust.

Bridge McFarland partner and medical law specialist Ian Sprakes said class actions were becoming increasingly important in helping victims of medical negligence to seek redress and financial compensation for their suffering.

He said: “This is already a huge potential class action but the number of women involved could yet more than double. About 1,500 women underwent operations carried out by Mr Rowland and subsequent investigations have apparently shown problems in about 30% of cases examined.

“Across the whole group, that would add up to about 450 cases where the operations were not carried out to a satisfactory standard.

“Many patients were left with chronic pain and weaker bladders following their operations.

“In this case, it appears that Mr Rowland warned his employers that he felt overwhelmed by his workload as long as five years before any action was taken. The message to all NHS trusts must be to listen and take meaningful action when staff, particularly surgeons, complain of overwork or being unable to cope.”

Mr Rowland was suspended by the trust in 2008. Managers said they acted in a timely and decisive manner based on the information available to them.
